These terms cover everything we sell: the Precision Business Catalyst Package, the Catalyst content subscriptions (Catalyst Growth and Catalyst Competitive), and Alice, our AI appointment center that answers a business phone line.
Most of this document applies to all of it. The sections about Alice are marked, and they only apply if you are using her.
1. Who you are agreeing with
Clear Way Through is operated by Aaron Wood, based in the Province of Quebec, Canada, as a department of Aaron Wood Creative. You can reach us any time at support@clearwaythrough.com, by phone at 1-888-514-2719, or by mail at Clear Way Through, PO Box 51035, RPO Faubourg de l'Île, Pincourt, QC J7W 3R2, Canada. In these terms, "we" and "us" mean Clear Way Through, and "you" means the business or person buying the service.
2. What we sell
- The Precision Business Catalyst Package. A one time strategy blueprint for your business.
- Catalyst Growth and Catalyst Competitive. Monthly content subscriptions. We produce and deliver the content described in your chosen plan. What we deliver each month is set out in that plan.
- Alice. An AI appointment center. She answers calls on a phone number we provide, talks to the caller, captures their details, and books appointments into your calendar. You get a report of the calls she took and the appointments she booked.
We produce content, strategy, and answered calls. We do not promise a specific number of followers, leads, customers, bookings, or dollars, and we never will. Section 19 covers this in full.
3. Alice is not an emergency service
Read this one before you buy.
Alice takes messages and books appointments. She does not triage, she does not assess urgency, she does not dispatch anyone, and she does not pass a call through to a human in real time. She cannot tell a routine call from a life threatening one, and she will not treat them differently.
No caller should rely on Alice in an emergency, and you must not present her as a service that can handle one. If your business takes calls where a delay could cause harm to a person or serious damage to property, you need a human on call and a real emergency line, and Alice is not a substitute for either. If you set Alice up as the only thing answering your line, calls that need immediate human attention will wait until you read your report.
You are responsible for telling your callers where to go in an emergency, and for keeping that route open. We recommend that your greeting, your voicemail, your website, and your after hours message all name it plainly.
4. Alice is an AI, and she says so
Alice is artificial intelligence. She is not a person, and we do not pretend otherwise. If a caller asks whether they are speaking to a human, she tells them the truth and names the company she works for.
You may introduce Alice as your front desk, your reception, or your booking line. You may not represent her as a human employee, give her a real person's name and history, or tell a caller she is a human being. If you do, these terms end and the service stops.
5. Alice records calls, and here is exactly what happens to the recording
Alice discloses at the start of every call that the call may be recorded. That disclosure is built into her opening and it is not removable.
- Who records. We do, through the companies that run the voice and the phone line.
- What is kept. An audio recording of the call, a written transcript, and the details the caller gave, such as their name, phone number, email, the reason for the call, and the appointment booked.
- How long. We keep the recording and the transcript for no longer than ninety days, then delete them. Appointment and contact records are kept while your account is active because they are the record of your own bookings.
- Where. Alice's voice runs on ElevenLabs and the phone line runs on Twilio. Both are United States companies and both process and store call data on servers in the United States. Our own booking and reporting system runs on hosted servers in North America. If your profession requires that this data stay in Canada, tell us before you start and we will tell you plainly whether we can do it.
- Who owns it. The caller information is yours. We hold it to run your service and for nothing else. We do not sell it, we do not rent it, we do not use it to market to your callers, and we do not use it for another client.
- When you leave. Ask us any time in the ninety days after you cancel and we will send you your caller and booking records in a file you can open. Section 14 sets out what happens to the rest of it.
Two things stay your responsibility, because they depend on your business and not on ours. First, any notice, posted sign, or written consent your profession or your regulator requires beyond the spoken disclosure Alice gives. Second, telling us before you start if you handle a category of information that carries its own rules, for example health records, so we can tell you honestly whether this service fits.
Our full privacy policy is at www.clearwaythrough.com/privacy-policy.
6. Alice speaks English
Alice's live voice runs on an English language model. She answers, converses, and books in English only. She does not currently take calls in French or any other language, and we will not tell you otherwise to close a sale. If your callers need service in French, this is not the right product for you today.
7. Your phone number stays yours
You keep your own business number. We give you a separate number, and you choose to forward your line to it, in whole or only when you do not pick up. You make that change and you can undo it yourself at any time.
We never take over, port, or take control of your existing business number. If you stop the service, you turn the forwarding off and your line rings the way it always did.
8. What Alice costs
Alice is priced in Canadian dollars, and buyers outside Canada are charged in US dollars. Stripe picks the currency from where your card was issued.
- Alice Answer. CA$99 a month, or US$69, including 150 minutes of calls.
- Alice Front Desk. CA$149 a month, or US$109, including 400 minutes of calls.
- Alice Full Desk. CA$299 a month, or US$209, including 1,000 minutes of calls.
- Setup. CA$249, or US$179, one time. Waived if you pay for a year up front.
Minutes are capped on every plan, and this is the one thing that can make an invoice larger than the sticker price. Calls past your included minutes are charged at CA$0.35 a minute, billed on your next invoice. Nothing else on an Alice plan carries a variable charge. We will email you when you pass your included minutes, so an invoice is never the first you hear of it, and if you are regularly going over we will tell you that the next plan up is cheaper for you than the overage.
Paying for a year up front costs ten months and gets you twelve, and the setup fee comes off.
The price you pay is the one shown at checkout on the day you sign up. If we change our published prices later, your price does not move until we tell you by email and your next renewal comes around, and section 22 covers how that works.
9. What the content services cost
- The Precision Business Catalyst Package. US$500, one time, or CA$700.
- Catalyst Growth. US$1,200 a month, or CA$1,700.
- Catalyst Competitive. US$2,500 a month, or CA$3,500.
Stripe charges you in the currency of the country your card was issued in. The price you pay is the one shown at checkout.
Anyone who buys the Precision Business Catalyst Package gets US$500, or CA$700, off the first month of whichever subscription they take afterward.
10. The seven free days on Alice
Before you pay anything for Alice, you get seven days free, on your own line, with your own callers. You get a report of every call she answered and every appointment she booked in that week.
Here is exactly how the money works, because a free trial that quietly turns into a bill is the thing people are right to be wary of.
You choose your plan and set the subscription up at checkout. Nothing at all is charged for the first seven days, including the setup fee. On the eighth day the first payment is taken and your plan runs from there. Cancel any time inside those seven days and you are never charged, the number stops answering, and you turn your forwarding off.
So the decision is real and it is yours, and the deadline is the seventh day. We will remind you before it arrives.
11. Billing and payment
Subscriptions are billed in advance through Stripe and renew on the same date each month, or each year on an annual plan, until you cancel. On Alice, the first payment comes at the end of the seven free days and everything runs from that date. Your card is charged automatically each period unless you cancelled before the renewal date. Alice overage from the previous period is added to the next invoice.
If a payment fails, we may pause delivery, and on Alice we may stop answering your calls, until it clears. You are responsible for keeping a valid payment method on file while your subscription is active.
12. Term and cancellation
You are not locked in. Every plan we sell runs month to month and you can cancel at any time. There is no cancellation fee, no minimum term, and no penalty. This is the same on Alice and on the content plans.
Your cycle date is the monthly anniversary of your first payment, not the first of the month. On Alice that is the day the seven free days ended, so a trial that started on the 7th makes the 14th your cycle date and the 14th of every month after it. Cancel before your cycle date and you are not charged again. Cancel after it and the month you have just been charged for is the month we deliver, and it ends there. Your cycle date is on your receipt and we will tell you what it is when you ask.
When you cancel, the switch off is not a promise somebody has to remember to keep. Cancelling runs an automated offboarding, the mirror of the onboarding that set you up. Your setup comes out of our system and, on Alice, the appointment center stops answering. That is why a charge after cancellation should not happen in the first place, and section 13 covers what we do if it ever does.
If you paid for a year up front and you stop early, we refund the whole months you have not used, charged back at the standard monthly rate rather than the annual rate, less the CA$249 setup fee that the annual price waived. That is the honest arithmetic of the discount: the annual price is lower because it was paid for a year, so a year that ends early is priced as the months you actually took.
On the content plans we ask for six months, and we want to be straight about why. Building an audience is slow at the start and compounds later. The first two months are mostly setup and testing, the middle months are where the pattern gets found, and the results that matter usually show up in months four through six. A client who leaves at week six has paid for the expensive part and left before the part that pays it back. That is our honest assessment of the program, and it is why we would rather you start when you can give it six months than start now and stop early.
That is a recommendation and not a term. You can cancel in month one and owe nothing further. If the six month timeline does not work for you, tell us before you subscribe and we will tell you plainly whether this is the right thing for you to buy.
13. Refunds
Two rules, and they are about two different things.
Time you have already had is not refunded. A month that has started is a month we deliver, on Alice because the calls have already been answered and on a content plan because the work is already underway. Cancelling stops every future charge, and you keep whatever was delivered for the periods you paid for.
A charge that should never have been taken is refunded in full. If you cancelled before your cycle date and a payment goes through anyway, that is our mistake and you get all of it back. Tell us at support@clearwaythrough.com and we do not argue about it.
Those two do not contradict each other. The first is about a month you received. The second is about a month you did not.
Cancelling inside the seven free days is neither of those. Nothing was charged, so there is nothing to refund.
The annual arithmetic in section 12 is the other case, and it applies to prepaid months you have not reached yet.
14. What happens when you cancel
This applies to every plan we sell. You are not left guessing what happened to your setup or to what we know about your business.
- The service is switched off and you come out of our system. On Alice, the appointment center stops answering and your dedicated number goes out of service at the end of the period you have paid for, or at the end of the seven free days if you never reached a paid one. On a content plan, delivery stops at the end of the period you have paid for.
- Your phone line goes back to normal. The forwarding sits on your own phone account and was never ours to touch, so you switch it off, and we walk you through it and confirm with you that your line is ringing the way it always did. Section 7 covers why we do it this way.
- You get an email confirming the cancellation, saying what was switched off and when.
- We keep everything for ninety days, in case you come back. That is your knowledge base, the way you were set up, and your records. Ask any time inside that window and we send you your caller and booking records in a file you can open.
- If you come back inside those ninety days, there is no setup fee. Your setup is still there and we switch it back on.
- At ninety days it is deleted. Your business details, your FAQ, your website information, your social media information, your hours, your services, your prices, your policies, your caller and booking records, and the whole knowledge base, which is the brain the appointment setter learned your business from. All of it comes out of our system.
- Three things survive, and nothing else: your email address, your public business contact information, and the name and contact details of the person we dealt with. That is because you are a past client and we would like to be able to say hello. Nothing about the inner workings of your business survives. What does survive is held in our customer system, Systeme.io.
15. Uptime, and the companies we build on
We aim to keep Alice answering around the clock and we watch the line, but we do not guarantee uninterrupted service. Alice depends on telephone carriers, a voice provider, a calendar provider, and internet infrastructure that we do not own and cannot control. When one of them has an outage, Alice is down until they are back, and the same is true of your own phone service.
We do not offer service credits for downtime, and we do not guarantee any number of answered calls, booked appointments, or dollars of revenue. What we sell is a service that answers your line and books appointments, run properly and watched. It is not a promise about what your callers will do.
Keep your own voicemail working. It is the fallback, and it costs you nothing to leave in place.
16. How you may and may not use Alice
You confirm the following, and it matters, because the exposure lands on you and on us both.
- You own the phone line you forward to us, or you have the authority to forward it.
- Alice answers calls that come to you. You will not use her to make outbound cold calls, telemarketing calls, or any unsolicited campaign, and we do not offer her for that.
- You will not use Alice for medical triage, legal advice, financial advice, crisis or emergency response, or anything else where a wrong answer from software could hurt somebody.
- You will not use Alice for anything unlawful, and you will follow the rules of your own profession and regulator.
- The information you give us to build Alice's knowledge, your hours, your services, your prices, your policies, is accurate and yours to give.
If any of this stops being true, tell us. If we find out it was never true, we can stop the service.
17. What you are confirming you understood
Before your first payment you confirm that you have read and understood the following:
- This is a service, not a guaranteed results service. We do not promise a number of followers, leads, customers, bookings, or dollars, and we never will.
- On the content program, meaningful audience results are not expected inside the first ninety days, and the program is designed on a six month horizon.
- What we deliver each month is described in your plan. If a month's deliverables arrive as described, we have met our obligation for that month, whatever your audience or your callers do.
- Alice is an AI, she is not an emergency service, and she records calls.
- You can cancel at any time and are not obligated to continue.
18. Feedback and public statements
If something is not working, tell us first. We would rather fix it than read about it, and you will get a real person and a real answer. That is an invitation, not a condition. It does not limit anything you are free to say publicly, before or after.
You are free to review us publicly, positively or negatively, at any time, including after you cancel. We do not ask you to waive that and we would not enforce it if you did.
What we ask is that anything you state publicly about us is accurate and based on your own actual experience with our service.
19. No guarantee of results
We provide a content service, a strategy service, and a call answering service. We do not guarantee any particular business outcome, audience size, ranking, revenue, call volume, or booking rate. Results depend on many things outside our control, including your market, your offer, your pricing, and your own follow through. Our obligation is to deliver the work described in your plan to a professional standard. It is not to produce a specific result.
20. Ownership and confidentiality of what we make for you
The strategy documents, research, content calendars, audience analysis, and other working materials we produce for you are yours to use for your own business, and they are confidential. They remain confidential after this agreement ends. You are free to use them for your own business. You are not free to publish them, share them with a competitor of ours, or resell or reproduce them as your own product.
The knowledge base we build for Alice, the way she is configured for your business, and the prompts behind her remain ours. The information you gave us to build it remains yours, and so does everything your callers tell her.
Nothing in this section prevents you from describing your experience of working with us.
21. Limitation of liability
To the fullest extent the law allows, our total liability to you for anything arising out of or related to this service is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect, incidental, or consequential losses, including lost profits, lost business, a missed call, a call that was answered badly, or an appointment that was booked wrong or not booked at all. Nothing in these terms limits any liability that cannot be limited by law.
22. Changes to these terms
We may update these terms from time to time. If we make a material change, we will let active clients know by email before it takes effect. The version in force is the one posted here on the date of your most recent payment.
23. Reservation of rights
Nothing in this agreement limits either party's rights under the law regarding statements of fact that are untrue.
24. Governing law
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Any dispute that cannot be resolved directly will be dealt with in the courts of Quebec.
25. Contact
Questions about these terms go to support@clearwaythrough.com and we will answer them.
